What do you do when a promise to pay is becoming a lie?

I was told in an email by a breeder in Iowa (also works for a financial institution) that I would be paid a small amount for a female I owned half of who died of strangulation in a hay rack when "every one" was at the fair-She produced a couple calves prior and I never asked for anything.But requested a small sum as a bunch of them were being sold as I had recieved nothing her whole life.2 plus weeks went by and "the check came back return mail happens all the time we will send it again". You bet-I get mail in 3 days from the Midwest all the time. 3 weeks have passed and  this time and no response from calls or emails. Do you  think that kind of behavior equates to being LIED TO? O0

Definitely sounds like you are getting the run around. With partners like that, who needs enemies , right?  <beer>

well you could look into filing a small claim-- $5000 or less in Iowa in the county where the person resides.    If it is over $5000 you have to have an attorney file in district court for you.  Do you have any agreements or contracts that the court would find favorable to you?  The small claim filing fee in Iowa is $85.00. 
Just an idea.

I would never be a partner with show ring people. Never never never. They are crooks and unethical by nature.

I agree with both Shorts For US and AJ-Unfortunately its too far away-I did get an email today with a financial analysis (only in Las Vegas or was that Nevada) of why he shoudnt owe me anything etc-This was after-(30 days or so ago) I got an initial email stating that he would send $450. Female orig sold for $3000-I let my half go so the kids could show her-He later paid them 1200 for her bred as a long 2 year pld right or wrong (certainly wasnt bred to the right bull start to finish) she did have 3 calves, and if she hadnt died in a hayrack due to basic malfeisence she would have had another-she raised em all fine-I guess my question other than him going back on his word Is a registered Shorthorn like her worth a total of $1650?-I only asked EN Total for $450-Instead I get nothing AND YES SHE WAS WAY HIGHER QUALITY THAN the $1200 that he paid and they don't go by the pound registered etc so don't try the tired cliches about: the sale barn, how lousy she was, and other stupidity. Shes pictured on grass raising calf 3 O0

If all people that show cattle are crooks and unethical, doesn't that include you ? Didn't you show cattle at Denver ?

I think some would be a better assessment-There are some that are crooks-there are some that are not real friendly and bunch that are great people and fun to be around.I agree on some certainly not all-I think he was referring to the more visible "operators " per se O0

The first thing you do......to try and win a show.....is lie about the birth date. You have to be a liar to even get in the club. I have exhibited cattle........just to get them out there.....

O0

OKAY Mr. Doc.....mister CNN......90% of people......the ones who lie about Birth dates......are the one ones I refer to. Its never 100%.

Just sayin!! You were painting with pretty broad strokes !! Just because you win or are competitive at a show doesn't mean you are a liar or unethical. I show cattle from time to time and have a lot of friends that do also. Don't think that they are liars or unethical or myself for that matter. Partners with several of them on cattle now and in the past and no issues.

First it is sad you have to go through this.  Small claims court is your best avenue but as the previous person stated you have to file it in the county they reside in.  If you do this have your ducks in a row. You appear to have an email that stated you would be paid.  That is good for you.  Not so for them.  Having been through small claims court in my business, when you file make sure you include any fees,  lost wages, travel costs, etc in the claim so you can be reimbursed should it take you a day off work just to file the claim.  It will go to SCC and you will get a say.  Understand the process for that county by talking to them.  Ours is such you show up on a day and they hear your case.  Mine did not show up and I was awarded my case but they paid on the absolute last day they could.  You have to decide if $450 is worth your time and effort.  Again, so sorry you have been led on but there really are great people in this industry.  Just the bad apples are pretty hard to forget.

Thanks Herfluver-not the amount-its the principle-The statute is 3-5 years but its not worth any more time at this point -I come out of the Construction end of things so although Ive never been sued-I have had to take action several times and generally pursuing a judgement needs to be worth the price of admission-I"m 900 miles away..  O0
